TERMS AND CONDITIONS OF SALE

PRICES: Chris Beard Agricultural and Plant Services Ltd reserves the right to amend prices and terms without prior notice, although every effort will be made to maintain prices as stated. Goods will be invoiced at prices in effect at the date of delivery. Prices are charged with 20% VAT at point of purchase.

PAYMENT: Full payment to Chris Beard Agricultural and Plant Services Ltd at point of purchase unless prior arrangement has been made with Chris Beard Agricultural and Plant Services Ltd, all goods remain the property of Chris Beard Agricultural and Plant Services Ltd until full payment balance is met. Late payments will occur a charge of 10% on each month missed payment from the oldest invoice.

PROCESSING YOUR PAYMENT:
After you place an order on our website you will need to make payment for the goods or services you have ordered. All payments made to the Company must be made by one of the following methods:
At checkout on website
By bank transfer or BACS;
By debit or credit card,

or

For Customers with an authorised credit account, by cheque. Chris Beard Agricultural and Plant Services Ltd will not accept payment in cash.

Without prejudice to any other rights of Chris Beard Agricultural and Plant Services Ltd , if the invoice is not paid in full by the due date interest shall be payable on any overdue amount from the date on which payment was due to that on which it is made (whether before or after judgement) pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.

The Customer shall also pay all legal costs (on an indemnity basis) and other costs incurred by the Company in recovering any amounts owing from the Customer and any Goods in which title has been retained by the Company. Such costs shall be due for payment immediately on invoice.

Chris Beard Agricultural and Plant Services Ltd reserves the right to apply amounts received first in settlement of interest on overdue debts and then of debts due, beginning with the oldest outstanding invoice.

If the Customer: fails to make any payment when and as due; exceeds any financial limit on the Customer’s account from time to time applied by the Company, or other circumstances occur entitling the Company to terminate the Contract, then the price of all such Goods as have been delivered or prepared for any order of the Customer shall become immediately due and payable.

DELIVERY:

Next day delivery is available for all deliveries within the UK, contingent upon orders being placed before 2:30pm on weekdays, excluding weekends and bank holidays.

For deliveries within the United Kingdom, any goods exceeding the value specified in your client trading contract will be shipped with carriage paid. However, please note that while we ensure the shipment is handled by an approved courier, the risk during transit is borne by the customer. Should you prefer alternative shipping arrangements, any additional costs incurred will be charged to your account.

Chris Beard Agricultural and Plant Services Ltd reserves the right to apply a surcharge for handling, packing, and shipping on orders that fall below the minimum value for prepaid carriage. This surcharge will be clearly itemized on your invoice.

In the event that a package is refused upon delivery without justification, the customer will be responsible for covering the return shipping costs and a 20% restocking fee.

Goods delivered to a third party, at the request of the customer, be at the risk of the customer.

It is preferable to REFUSE DELIVERY from the carrier attempting delivery of any damaged goods. If you do accept the package, you must make sure it is noted on the carrier’s delivery records in order to file a damage claim from Chris Beard Agricultural and Plant Services Ltd.

Keep the product together with the original packaging and notify us immediately. Failure to notify Chris Beard Agricultural and Plant Services Ltd of damaged goods within 24 hours of delivery it will be assumed that delivery was to customers satisfaction therefore, will not be eligible for return on the bases the product was damaged during transit.

RETURNS:
All products returned must be complete and contain ALL original packaging to include packing materials, manuals, blank warranty cards, accessories and any other documentation included with the original package. We make a surcharge of 20% on parts returned. If items returned are dirty or damaged, then any refund will be at Chris Beard’s discretion if a refund is to be issued.

The Customer is responsible for returning products at their own expense therefore, the customer should ensure they use a carrier that is able to provide proof of delivery.

For customers protection, it is strongly recommend that the item is fully insured for return in case of any loss or damage, as Chris Beard Agricultural and Plant Services LTD cannot refund what is not received and will not refund any damaged items in transit received also.

FAULTY items can be accepted within 14 days on receipt of the package for refund or replacement. If we have sent you an incorrect product, we will exchange or provide a refund or credit. a replacement item (if required) will be sent as soon as the faulty item received by Chris Beard Agricultural & Plant Services Ltd.

NON-FAULTY returns can be accepted within 14 days of receipt of the package on condition that shipping charges of all NON-FAULTY returns will be non-refundable however can be credited to account.

CANCELLATION OF GOODS: Every effort will be made to carry out the contract, but its due performance is subject to cancellation by Chris Beard Agricultural & Plant Services Ltd, or to such variation as it finds necessary as a result of any Act of God, War, Strike, Lockout, or any other Dispute, Flood, Fire, Drought, Legislation, or other causes (whether of the foregoing class, or not) beyond the Company’s control. No responsibility is accepted by Chris Beard Agricultural & Plant Services Ltd for late deliveries.

WEBSITE ORDERING: By completing and submitting a order request on our website (or proceeding through the ‘checkout process’) you are making an offer to purchase goods which, if accepted by us, will result in a binding contract at the point of delivery of goods. Neither submitting an electronic order form or completing the checkout process constitutes our acceptance of your order. In the case of pricing errors or the non-availability of advertised products, Chris Beard Agricultural & Plant Services Ltd reserves the right to cancel your order and refund you.

IN ADDITION when returning please include a letter with the following information: Invoice/Order Number, Your Name, Address, E-mail Address and Reason for Returning item.
